1. Eligibility

Entry is only open to Australian residents aged 18 years or older.

Employees (and their immediate families) of the Promoter and agencies associated with this promotion, including all subsidiaries and affiliates are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

2. Promoter

Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Instagram Terms of Use, which can be found at http://instagram.com/about/legal/terms.

This promotion is not sponsored, endorsed, administered by, or associated with Instagram or any of its affiliates. Entrants understand that they are providing their information to the Promoter and not to Instagram. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Instagram. Instagram will not be liable for any loss or damage or personal injury which is suffered or sustained  by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.

3. Agreement to Terms and Conditions

Information on how to enter and the prize forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 

4. Entry Period

The Promoter will receive and accept all entries between 2:00PM AEDT Thursday 19th December 2024 and 11:59PM AEDT Thursday 26th December 2024 (“Promotional Period”).

Entries will not be accepted outside of the Promotional Period. 

5. How to Enter

To be eligible to enter, individuals must complete the following steps during the Promotional Period: 

  1. Visit and “follow” the Promoter’s Instagram account at @myconnect_aus (https://www.instagram.com/myconnect_aus/) ;
  2. Locate the promotional post on the Instagram account; and  
  3. Like and tag a friend in the promotional post on Instagram. 

Individuals will receive a maximum of one (1) bonus entry if the individual shares the promotional post to their story on Instagram and tags the Promoter’s account. To be eligible for a bonus entry, individuals with private Instagram accounts must take a screenshot of their shared story and send it via direct message to the Promoter’s account on Instagram during the Promotional Period. 

6. Prize

The first valid entry drawn will win one (1) x $500 Vault Pays-enabled Prepaid Mastercard®.

The gift card is a virtual prepaid MasterCard meaning that it will be sent to the winner’s mobile number provided via direct text message through the Promoter’s gift card partners Vault Pays-enabled Prepaid Mastercard®.

Any ancillary costs associated with redeeming the Vault Pays-enabled Prepaid Mastercard are not included. The Vault Pays-enabled Prepaid Mastercard must be activated within two (2) months of issue and is valid for twelve (12) months after activation. At expiry of the Vault Pays-enabled Mastercard, any unused balance will be forfeited. The Promoter will not give the winner notice prior to expiry. Card expiry and balance can be found on the winner’s mobile device in the winner’s digital wallet. The Vault Pays-enabled Prepaid Mastercard is issued by EML Payment Solutions Limited (ABN 30 131 436 532) AFSL 404131 pursuant to license by Mastercard.  See www.vaultps.com.au/terms for terms and conditions. Any unused balance of the Vault Pays-enabled Prepaid Mastercard will not be awarded as cash. Redemption of the Vault Pays-enabled Prepaid Mastercard is subject to any terms and conditions of the issuer including those specified on the Vault Pays-enabled Prepaid Mastercard. 

The prize is not transferable, exchangeable or redeemable for cash and may be substituted at the Promoter’s sole discretion.

Total prize pool value is $500. 

7. Odds

The odds of winning are dependent on the number of eligible entries received.

8. Selection and Notification of the Winner

The draw will take place at the Promoter’s office at Level 6, 267 Collins Street, Melbourne, Victoria, 3000 on 27/12/2024 at 2:00PM AEDT. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

The winner will be notified within two (2) business days in writing via an Instagram direct message to the account used to enter the promotion. 

The Winner’s details (initial, surname and postcode) will be published on https://www.myconnect.com.au/fyf-winners/ from 03/01/2025 

Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize within two (2) weeks of being notified by the Promoter, then the prize will be forfeited.

The Promoter will not be liable for the winner’s failure to receive notification of winning if they have provided incorrect details or cannot access the Instagram account they entered the competition with. 

The Promoter’s decision is final and no correspondence will be entered into.

A draw for the prize, if unclaimed, may take place on 28/01/2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified in writing within two (2) business days of the draw via an Instagram direct message to the Instagram account used to enter the promotion and their name will be published (initial, surname and postcode) on https://www.myconnect.com.au/fyf-winners/ from 4/02/2025

9. General Terms & Conditions

The Promoter, reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

Incomplete, indecipherable or illegible entries will be deemed invalid.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

The Promoter reserves the right to modify, suspend, cancel, or terminate the promotion in the event of non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Promoter’s control that impact or corrupt the security, fairness, proper conduct, or administration of the promotion.

If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. Additionally, the Promoter may seek damages to the fullest extent permitted by law if a participant is found to have deliberately caused damage or undermined the legal operation of the promotion. 

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. 

The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

10. Limitation of Liability

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the entrant agrees to release and hold harmless the Promoter, its subsidiaries, affiliates, employees, agents, and representatives from any and all claims, liability, illness, injury, death, loss, or damages (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the promotion or the use or misuse of the awarded prize.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, agents, subsidiaries and affiliates) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.  

11. Privacy 

The Promoter collects personal information (“PI“) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.myconnect.com.au/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.

The privacy of your PI is a priority for the Promoter. The Promoter respects your rights to privacy under the Privacy Act 1988 (Privacy Act) and we are committed to complying with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) requirements for collecting and managing your PI.
